MINUTES OF THE SHAFTSBURY PLANNING COMMISSION
September 14, 2004, COLE HALL, SHAFTSBURY, VERMONT
Board Present: David Mance, Mark Young and William Jakubowski, [7:53pm].
Board Absent: Kevin Bubriski, Chairman, and Andrew Knafel.
Other’s Present: Edwin Colvin, John Tiffany, Jim Mead, Chuck Bushey, Audrey and Harvey Rutheiser, Karen Mellinger, William Pennebaker, Forrest Snyder, Mike Gardner, Barry Maier, Mike Biddy, Jim Serrao, Trevor Mance, Anastasia Satterthwaite, Anthony Zazzaro and Cynthia Thomayer.
Call to Order: Mr. Jakubowski called the meeting to order at 7:55pm.
Old Business:
A: David Mance: Final Hearing: Two Lot Subdivision Lake Drive: Due to the excessive delays in the processing of the subdivision, and in consideration of comments offered by Mr. Chuck Bushey, it was determined that this Final Hearing must be rewarned and all adjacent landowners and the Paran Homeowner’s Association be notified. Mr. Zazzaro will rewarn this for October 12th, 2004.
B: Carol Bloomquist: Review of Permits & Set to Warn: Due to lack of a quorum, (Mr. Mance is presenting), this was tabled until the September 28th, 2004 meeting.
New Business:
A:Sage City: Preliminary Review & Classification: Set to Warn: Due to lack of a quorum, (Mr. Mance is presenting), this was tabled until the September 28th, 2004 meeting.
B: Eagle Square Museum: 2 Lot Subdivision: Review & Classification:*[see below]: Due to lack of a quorum, (Mr. Mance is presenting), this was tabled until the September 28th, 2004 meeting.
C: Solid Waste Task Force Committee Update: Mr. Pennebaker distributed the subcommittee’s report explaining that it contained various options, whereby more than just one option could have been acceptable to members of the subcommittee, hence broadening the range of acceptable options to present to the Planning Commission for their consideration. Mr. Pennebaker asked that all members of the Planning Commission review this compilation of various options and be ready to discuss them at the September 28th meeting. In addition, Pennebaker explained that if the SWTFC is to continue beyond October, then a permanent committee with a less rigourous schedule will need to be compiled. In addition, Mr. Pennebaker informed the Planning Commission of the binder housed in the Town offices which provides background information for the report submitted. Discussion ensued with regards to the need for the Planning Commission to provide some direction to and SWTFC, which is inclusive of the communities needs as well. With this, Mr. Young made a motion to accept this report from the SWTFC, and to forward to the full board for their preliminary review and to schedule for discussion at the September 28th, 2004 meeting. Mr. Mance seconded said motion. Motion carried 3-0-0.
Zoning Administrator’s Report: Mr. Zazzaro reported that Valerie Shemeth has listed for sale, the former Thomson property, and there is no subdivision permit on file. Mr. Mance, with concurrence from Mr. Colvin, explained that this is illegal whereas the Planning Commission directed Mr. Zazzaro to find the Zoning Regulation that governs this and send Mrs. Shemeth a letter to this regard.
Mr. Zazzaro questioned the Planning Commission on whether commercial applications must come before them? Mr. Mance explained that ALL commercial applications must come before the Planning Commission and that a copy of a L&I permit must also be presented.
Other Business: Discussion ensued with regards to firewood operations being conducted on Route 67A, one being Richard Lindsey and another out of a trailer facility. The Board directed Mr. Zazzaro to investigate.
*[From New Business Section B above]: Mr. Edwin Colvin, President of Friends of Eagle Square, requested the following clarification from the Planning Commission: Mr. Colvin explained that this proposal is for a museum in the 10,300 square foot old square shop of Stanley Tools, which has been deeded to Friends of Eagle Square. Mr. Colvin detailed that he had met with a representative of Ted Gladstone and this property has been perced, but according to Jim Secor, on behalf of Ted Gladstone, needs a change in zoning from Industrial to Commercial to accommodate a museum. With this, the Planning Commission researched the bylaws according to permitted uses in both Commercial and Industrial areas and determined that a zoning change is not necessary to accommodate a museum. With this, Mr. Colvin asked for this determination to be given to him in writing.
Other Business (continued): Mr. Colvin questioned the process that occurs when the Zoning Administrator issues a permit that is not completed within a year? Mr. Zazzaro explained that a permitee has up to two extensions when the appropriate fee is paid. After this time, there is no penalty for anyone. Mr. Jakubowski researched the Vermont State Zoning Regulations which provides for the remedy of $100 per day fine for an uncompleted permit, after a 7 day notification to the permit holder.
Interoffice Memo from Town Administrator Aaron Chrostowsky regarding a strategic Meeting scheduled for Wednesday, September 22nd, 2004 from 12:30 – 4:00pm. It was decided that Mr. Jakubowski will attend this meeting representing the Planning Commission.
General discussion ensued with regards to requiring a statement from applicants concerning conformity to Vermont State Energy Conservation Code in regards to part of the permitting process.
With no further business before the Commission, Mr. Mance made a motion to adjourn at 9:11pm. Mr. Young seconded said motion. Motion carried unanimously.
