MINUTES OF THE SHAFTSBURY PLANNING COMMISSION

APRIL 22, 2003, COLE HALL, SHAFTSBURY, VERMONT

 

Board Present: Andrew Knafel, Chairman, Kevin Bubriski, Vice-Chairman, William Jakubowski, David Mance, Mark Young and Jim Serrao.

Board Absent: None

Other’s Present: Chris Heins, representing Ron and Anabel Dwyer, Jon Endres for Bill Thomson, Bill Thomson and Cynthia Hamilton.

Mr. Knafel called the meeting to order at 7:32pm.

New Business:

1. Application #03-6074: William Thomson to construct a second single family home on one lot. This is located in the RR80 District.

Mr. Jon Endres distributed site plans for the commission, detailing this application as follows: Mr. Thomson is proposing to construct a single family dwelling, 26’ x 36’, on his 59.5 acre lot located on the westerly side of Cross Hill Road. This dwelling will be located on the top of the knoll, and used intermittently as the owner desires, stating that it is neither a primary nor secondary residence. Mr. Thomson further detailed that he has no intentions of creating sub-divided parcels on his property. Mr. Endres reviewed the septic design as a siphon fed conventional septic system, with a 420 gallon per day capacity, designed to support up to three bedrooms. Mr. Thomson detailed that the power supply to this dwelling will be of solar, gas, wind or generator type, to be determined in the future. Mr. Endres detailed that the parcel under review could easily be separated to conform to zoning bylaws, noting that the access to this proposed dwelling is a 12’ gravel based road.

Discussion then ensued with regards to the quarry issues Mr. Thomson previously faced. Mr. Thomson noted that Eric Gilbertson, the VT State Archeologist determined that the historic quarry, encompassing 100 – 150 square feet in circumference is actually located approximately 250’ North – Northwesterly of his proposed dwelling. Mr. Thomson then detailed for the Commission the process by which this was determined. With this discussion, the Commission requested that the quarry be scaled into the larger site map, to provide clarity with the proposal. Mr. Knafel distributed a letter the Commission received from Eric Gilbertson, detailing the exact location of this quarry.

With no further discussion, Mr. Mance made a motion to close said hearing. Mr. Jakubowski seconded this motion. Motion carried 5-0-0.

Mr. Jakubowski made a motion approve this site plan application as with the following conditions:

1. Detail the proposal as a one family dwelling vs. a camp.
2. Detail the quarry area to scale on the large site map, inclusive of offsets to the adjacent property lines.
3. Pending receipt of the required State Permit, with the number of such detailed on the plat.

Motion carried unanimously.

2. Application #03-257-S: Ronald and Anabel Dwyer for abandonment of subdivision #96-172, combining two lots into one. This is located in the RR40 District.

Chris Heins, representing the Dwyer’s, detailed that this proposal is to rejoin two lots to accommodate a larger house currently being constructed which entails the septic being located on one lot and the well for water on the other. Mr. Heins noted that the State of Vermont has been notified and the State Permit is being modified to reflect this change. The Commission reviewed this proposal using the tax map, as a reference, instructing Mr. Heins that a new plat will need to be filed to accommodate this proposal, as Mr. Mance noted that once a new map is filed the lot cannot be sold separately. With this, Mr. Mance made a motion to warn this for the next meeting of the Shaftsbury Planning Commission as a boundary relocation, with a State Permit required at that time. Mr. Young seconded. Motion carried unanimously.

Mr. Mance, recusing himself from the Commission, provided a preliminary summary of a deed overlap on the Herbert Treible property located on Timber Trail Road. Mr. Jakubowski made a motion to warn this property line relocation for the May 27th, 2003 meeting of the Commission. Mr. Bubriski seconded this motion. Motion carried 5-0-0.

Other Business:

The Shaftsbury Planning Commission instructed Anthony Zazzaro, Zoning Administrator to contact Mr. Anthony Mazzola of Shaftsbury Saab regarding the number of wrecked/part cars currently being held on his property.

Minutes:

Mr. Mance made a motion to approve the minutes of April 8th with the following corrections:

1. Application #03-6069:

A. Line 7 should read: “…would be rented to only one licensee…”
B. Line 17 should read: “…in rear of building only with an option…
C. Replace resident with residence.
D. Line 22 should read: “…in the Village Commercial 1 District…”

Mr. Young seconded this motion. Motion carried unanimously.

Old Business:

The Shaftsbury Planning Commission decided that they would like to conduct and on-site at 6:30pm on May 14th, 2003 to review the Brent Peacock application. Mr. Zazzaro will send Mr. Peacock a letter notifying him of this, as well as the Shaftsbury Zoning Board of Adjustment.

Mr. Knafel noted that the Shaftsbury Selectboard has cancelled their on site review for reclassification of Sawmill Road slated for May 03rd, 2003.

Mr. Bubriski distributed a recent article from the Rutland Herald in regards to Dailey’s C&D project.

Shaftsbury By-Law Update: Discussion ensued with regards to constructing interim By-Laws to address multiple uses of an undersized lot, and the sound ordinance. Mr. Jakubowski will contact Jim Sullivan from BCRC for assistance in addressing these two areas.

With no further business before the Commission, Mr. Mance made a motion to adjourn at 8:50pm. Mr. Bubriski seconded. Motion carried 5-0-0.
